Welcome to Almari. The terms "we", "us", and "our" refer to Alice Marie Ltd, a company registered in England and Wales (company number 17126048), trading as Almari. Alice Marie Ltd operates this store and website, including all related information, content, features, tools, products, and services in order to provide you with a curated shopping experience (the "Services"). Almari is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or the Privacy Policy, you should not use or access our Services.

1. Access and account

By agreeing to these Terms of Service, you confirm that you are at least 18 years old, or the age of majority in your country or region of residence, and that you have given consent for any of your minor dependents to use the Services on devices you own or manage.

To use the Services, including browsing the store or making a purchase, you may be asked to provide certain information such as your email address, billing, payment, and shipping details. You confirm that the information you provide is correct, current, and complete, and that you have the right to provide it.

You are responsible for keeping your account details secure and for all activity on your account. You may not transfer, sell, assign, or license your account to anyone else.

2. Our products

Every effort has been made to present the products in the store accurately. However, please note that colours and product appearance may differ slightly from how they appear on your screen due to your device's settings and configuration.

Because pieces are handmade, each one will have its own marks and small variations. Made-to-order and bespoke pieces are made individually and will not be identical to the photos. This is part of how the work is made, and is described in more detail on the relevant product pages.

Product descriptions and availability may change at any time without notice. We reserve the right to discontinue any product or limit quantities offered.

3. Orders

When you place an order, you are making an offer to purchase. Almari reserves the right to accept or decline your order for any reason. Your order is not accepted until Almari confirms acceptance, and payment must be received and processed before your order is accepted. Please review your order carefully before submitting it, as Almari may be unable to cancel orders after acceptance, particularly for made-to-order or bespoke pieces where work begins promptly.

Your purchases are subject to our Refund Policy.

You confirm that your purchases are for personal use and not for commercial resale or export.

4. Prices and billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a piece will be the price in effect at the time the order is placed, as confirmed in your order confirmation email. Unless otherwise stated, prices do not include shipping, customs, or import duties for international orders.

Promotional offers may be governed by their own terms. If there is a conflict between those terms and these Terms of Service, the promotional terms will apply.

You agree to provide accurate, complete, and current information for all purchases. You confirm that the payment information you provide is correct, that you are authorised to use the payment method, and that you will pay all charges at the prices in effect, including shipping, taxes, and duties where applicable.

5. Shipping and delivery

Shipping and delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once a piece is handed to the carrier, responsibility for it transfers to you.

6. Intellectual property

The Services, including all trademarks, brand names, designs, text, images, graphics, photography, and the arrangement of the website, are owned by Alice Marie Ltd or its licensors and are protected by UK and international intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, publicly display, republish, download, store, or transmit any material from the Services without prior written consent. Nothing in these Terms grants you any rights to Almari's trademarks, logos, or designs.

Almari's name, logo, product photography, and designs are trademarks of Alice Marie Ltd. You must not use them without prior written permission. Shopify's name and logo are trademarks of Shopify. All other names, logos, product names, and designs on the Services are the trademarks of their respective owners.

7. Third-party links and tools

The Services may contain links to third-party websites or include third-party tools and functionality. We are not responsible for the content, accuracy, or practices of any third-party websites or tools, and we are not liable for any harm or losses related to your use of them. If you choose to follow a link or use a third-party tool, you do so at your own risk. Please review the third party's terms and policies before using their services.

8. Relationship with Shopify

Almari is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through the Services are made directly with Alice Marie Ltd. Shopify is not responsible for any aspect of the sales between you and Alice Marie Ltd, including any injury, damage, or loss resulting from purchased products. You release Shopify and its affiliates from all claims, damages, and liabilities arising from your transactions with Alice Marie Ltd.

9. Privacy

All personal information collected through the Services is subject to our Privacy Policy. Some personal information may also be subject to Shopify's Privacy Policy. By using the Services, you confirm that you have read and understood both.

10. Feedback

If you send Almari any ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant Alice Marie Ltd a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium, including for commercial purposes.

You confirm that you own the rights to the Feedback you submit, that you have disclosed any compensation received in connection with it, and that the Feedback complies with these Terms. Alice Marie Ltd is not required to keep your Feedback confidential, pay for it, or respond to it.

Alice Marie Ltd may, but is not obliged to, monitor, edit, or remove Feedback that we determine to be unlawful, offensive, defamatory, obscene, or otherwise inappropriate, or that violates these Terms.

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions, including in product descriptions, prices, promotions, shipping charges, and availability. We reserve the right to correct any errors, change or update information, or cancel orders at any time, including after an order has been placed.

Except where expressly stated, the Services and all products offered through them are provided "as is" and "as available" without any warranties or conditions of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that your use of the Services will be uninterrupted, timely, secure, or error-free.

Nothing in these Terms is intended to limit or exclude any statutory rights you have as a consumer under UK or applicable consumer law that cannot be excluded by contract.

15. Limitation of liability

To the fullest extent permitted by law, Alice Marie Ltd, its directors, employees, partners, contractors, and licensors, and Shopify and its affiliates, will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, loss of data, replacement costs, or similar damages, arising from your use of the Services or any products purchased through them. This applies whether the claim is based on contract, tort (including negligence), strict liability, or otherwise, and even if Alice Marie Ltd has been advised of the possibility of such damages.

Alice Marie Ltd will notify you of any claim that requires indemnification. Failure to promptly notify you will not relieve you of your obligations unless you are materially prejudiced. Alice Marie Ltd may control the defence and settlement of any claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent, which will not be unreasonably withheld. You agree to cooperate in the defence of indemnified claims.

17. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed from these Terms. This will not affect the validity of any remaining provisions.

These Terms of Service and any related agreements are governed by the laws of England and Wales. You and Alice Marie Ltd agree to submit to the exclusive jurisdiction of the courts of England and Wales for any disputes arising out of or relating to these Terms or the Services.

The most current version of these Terms is always available on this page. We may update, change, or replace any part of these Terms by posting updates to the website. It is your responsibility to check the Terms periodically for changes. Where the law requires, we will notify you of material changes. Your continued use of the Services after changes have been posted constitutes acceptance of those changes.
